Prior to the start of the design process, the CLIENT (you) is required to submit a non-refundable deposit of 1/3 of the quoted price for the project. The remaining balance of the quote will be due as two subsequent payments: 1/3 after the CLIENT approves the proof, and 1/3 once the SELLER (martha makes designs) has shipped the final invitations.

CANCELLATION BY MARTHA MAKES DESIGNS FOR ANY REASON

SELLER cannot be held responsible for unforeseen circumstances, work-stoppages, "acts of God", which may make it impossible for the SELLER to complete the job in a reasonable amount of time. SELLER's obligation to CLIENT may be discharged in its entirety by a refund of the deposit, without prejudice, and disclaiming any secondary consequences or costs that the CLIENT may incur. If there is substantial reason not to move forward with any part of the project, a refund will be assessed and the CLIENT will be required to sign a refund form with agreed refund amount.

CANCELLATION BY CLIENT FOR ANY REASON

If the CLIENT decides to cancel the job prior to any part of it going to press, the CLIENT agrees to forfeit the initial deposit. Cancellations after the job has been sent to press will not be accepted. All quantities of each item provided in the final design release are covered by this clause upon acceptance of this contract.

By agreeing and signing below, the CLIENT certifies that the agreement has been read thoroughly. CLIENT also understands and agrees to the following SELLER's (martha makes designs) terms.
All deposits are non-refundable, and CLIENT has read and understands the cancellation policy as listed above. design work will not commence until an executed contract and deposit is recorded.

ARTWORK PROOF & APPROVAL

CLIENT will receive a digital design proof of the project. The design proof will illustrate the finished product. CLIENT understands that final approval of the design proof acknowledges that the CLIENT has thoroughly reviewed it for accuracy including but not limited to wording, spelling, dates/times, design, and all other content and style, and has confirmed that it is error-free and has met all of CLIENT’s requirements. Please note that once the CLIENT has given approval, the CLIENT will bear the final responsibility for the design and typographical elements of the order. The SELLER may make slight formatting adjustments without notice. CLIENT will be solely responsible for all costs for reprinting due to errors identified after CLIENT’s approval of the proof. Refunds will not be given once production has started. No final print work will be started until CLIENT has confirmed acceptance of the proof in writing or email.

NATURAL VARIATION & ASSEMBLY

Due to the handmade nature of the goods created and purchased, the CLIENT understands there may be very slight variations in each item. The CLIENT is responsible for the assembly of the final product and preparation for mailing. The SELLER offers assembly services and pricing depends on the complexity of the final piece. Please ask for a quote.

All design, images, fonts and concepts are subject to copyright and may not be reproduced, copied, printed or used for any other reason without express consent by the SELLER. Any concepts created throughout the design process, whether they are used in the final product or not, remain the intellectual property of SELLER. The SELLER reserves the right to use such concepts in both digital and physical portfolios, including, but not limited to, use on SELLER's website and social media, promotional items, or as samples in the SELLER’s studio.

POSTAGE

Postage is the responsibility of the CLIENT, unless otherwise stipulated in the contract. SELLER makes no implied claims or warranties for the cost of postage to mail products. SELLER is not responsible for any damages to items once out of possession, including damages or loss incurred as a result of postal equipment, shipping equipment, inclement weather, or other situations beyond SELLER's control.
